Terms of Service

These Terms of Service (“Terms”) govern your use of the websites, applications, and digital products operated by Mishra Agritech Pty Ltd (“Mishra Agritech”, “we”, “us” or “our”), including our AI-powered astrology app (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Our Services

We provide digital products and services, including an online AI-powered astrology application that generates personalised readings, birth charts, and related content based on information you provide. Some features are free; others may require a paid purchase or subscription, which will be clearly indicated before you pay.

2. Important disclaimer — astrology content

Content in the Services may be generated or assisted by artificial intelligence. While we work to make it thoughtful and relevant, AI outputs can be incomplete or inaccurate, and no outcome, prediction, or result is promised or guaranteed.

3. Australian Consumer Law — your guarantees

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). For major failures with a service, you are entitled to cancel your service contract with us and obtain a refund for the unused portion, or compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the ACL or any other applicable law that cannot lawfully be excluded, restricted, or modified.

4. Accounts

• You must provide accurate information when creating an account and keep your login credentials secure.
• You are responsible for activity that occurs under your account.
• You must be at least 18 years of age to use the Services.
• Notify us promptly at hello@mishraagritech.com if you suspect unauthorised use of your account.

5. Purchases, subscriptions, and refunds

Prices for paid features will be displayed before you buy. Purchases made through an app store (such as the Apple App Store or Google Play) are also subject to that store's terms, and subscription management and cancellation are handled through your store account. Cancelling a subscription stops future renewals; access continues until the end of the current billing period. Refunds are provided in accordance with the Australian Consumer Law (see section 3) and, where applicable, the relevant app store's refund policies. Change of mind alone does not create a right to a refund, except where required by law or an applicable store policy.

6. Acceptable use

When using the Services, you must not:

• use the Services for any unlawful purpose or in a way that infringes the rights of others;
• attempt to gain unauthorised access to the Services, other users' accounts, or our systems;
• reverse engineer, scrape, or resell the Services or their content without our written permission;
• upload malicious code or interfere with the proper operation of the Services; or
• use the Services to harass, abuse, or harm another person.

7. Intellectual property

The Services — including software, design, text, graphics, logos, and content we create — are owned by or licensed to Mishra Agritech and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the Services for your own personal, non-commercial use. Personalised readings generated for you may be kept and shared for your personal use; all other rights are reserved.

8. Privacy

Our collection and handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.

9. Liability

To the maximum extent permitted by law (and subject always to section 3 above), we exclude all liability for indirect or consequential loss arising out of or in connection with the Services. Where our liability for breach of a non-excludable guarantee can lawfully be limited under section 64A of the ACL, our liability is limited, at our option, to the resupply of the relevant services or the payment of the cost of having the services supplied again.

10. Changes, suspension, and termination

We may update, add to, or remove features of the Services over time, and may suspend or terminate access for breach of these Terms. You may stop using the Services and delete your account at any time. We may amend these Terms by publishing an updated version at mishraagritech.com/terms; material changes will be notified through the Services, and your continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them.
